GENERAL TERMS AND CONDITIONS

  1. General
     
    1. The following general conditions (hereinafter referred to as the "conditions") apply when you as a consumer (hereinafter referred to as "you") place an order within the EU via get.smoooth.com (hereinafter referred to as the "site"). The contract entered into between you and GEP Communication Group AB, Warfvingesväg 30A 112 51 Stockholn, corp. ID no. 556612-0928 (hereinafter referred to as "GEP", “us” or “we”). Full details of GEP are set out in Section 16. below.
       
    2. GEP abides by the regulations and directives set out concerning mail-order sales
       
    3. In order to be able to place orders on this site, you must be at least 18 years of age and provide a delivery address within the EU. GEP reserves the right to refuse an order if you provide incorrect information or provide a delivery address that is located outside of the EU.
       
    4. Please ensure that you have read and understood the conditions before placing your order. We reserve the right to amend these conditions as required without advance notice. This version of these terms, which apply to your order, is the version available on our homepage at the moment you place your order.
       
    5. GEP strives in as correct a manner as possible to demonstrate the products’ characteristics, including the composition and colour. We reserve all rights in the event of products being sold out, as well as for any errors in images or in the text on the site, for example, errors in the product description or technical specification, wrong prices, and price adjustments (such as changes in prices charged by suppliers or changes in currency exchange rates) or erroneous information with regard to whether a product is in inventory. GEP is entitled to correct any such errors and to modify or update the information at any time. If the wrong price has been indicated for a product that you have ordered, GEP will naturally notify you about this and await your approval of the corrected price before GEP continues with the order.
       
    6. That products are provided on the site at a given point does not imply, not is it a guarantee, that these products are always available. We reserve the right at any time to stop selling a given product.
       
  2. Order/Preparation of Contract
     
    1. In order to be able to place an order via the site, you must accept the conditions. By accepting the conditions, you are obliged to comply with the conditions in their entirety, and confirm that you have read and understood the information about personal details and cookies in accordance with GEP’s Privacy Policy, which can be seen here.
       
    2. Once you have placed your order in accordance with the conditions, we will e-mail you an order confirmation. If for some reason we cannot send you your order after you have received an order confirmation, we will inform you as soon as possible. If we have already received payment for such an order, we will refund you the amount in question using the same payment method that you used when you placed your order, in so far as such is possible. If for any reason the refund must be made in some other manner, GEP will contact you to ensure that the refund can be made by a different payment method.
       
    3. A purchase agreement is entered into only once GEP has confirmed your order and you have received an order confirmation from GEP by e-mail. GEP urges you to save this order confirmation for any contact you may have with GEP’s customer service.
       
  3. Prices and Fees
     
    1. The prices shown on the site include VAT and shipping costs. The conditions for the various payment method alternatives are shown in Section 5.
    2. The total cost of your order is the price of the ordered products.
    3. Free shipping applies to the default delivery method when ordering on our site.
       
  4. Promotional Campaigns and Special Offers
     
    1. From time to time, GEP may post promotional campaigns on the site that have conditions that are more favourable (hereinafter referred to as “more favourable conditions”) than those set out in these conditions. Such more favourable conditions apply for as long as the promotional campaign is active and apply to the specific products that GEP indicates within the context of the campaign. GEP reserves the right at any time to rescind the promotional campaign. Once a promotion campaign has expired or has been rescinded, these conditions will apply without modification.
       
  5. Payment Method

     
    1. Together with Klarna Bank AB (public JSC), corporate ID no. 556737-0431, Sveavägen 46, 111 34 Stockholm, Sweden, (hereinafter referred to as “Klarna”), we offer you an opportunity, upon the purchase of products on the site, to pay directly via Klarna Checkout, please see below for more information. Payment methods in accordance with Sections 5.2 - 5.4 below are handled in accordance with the Swedish Data Protection Act and Klarna’s privacy policy.  The various payment methods will be clearly marked at the checkout stage.     2. Card payment - pay directly with Mastercard or Visa. Klarna securely stores your details - the next time you shop, you do not need to enter your details again.
       
    3. Pay within 14 days - payment is due within 14 days of your products being sent. You can read more about invoicing conditions here.  
       
    4. Account - Klarna konto is a credit facility provided by Klarna that allows you to pay for your purchase in monthly instalments. You can read more about Klarna konto here.
       
    5. GEP and its cooperative partners reserve the right to conduct a credit review when payment is made pursuant to Section 5.3 or 5.4. ?? 

6.Delivery
 

  1. GEP strives to send your order off as quickly as possible in accordance with the selected delivery method and in the order in which we receive the orders.
     
  2. Our goal is to deliver within 3-5 working days after we have received and confirmed your order via an order confirmation. Your order will be delivered directly to the address that you provided when placing your order, or to a postal outlet (hereinafter referred to as a “delivery office”). Once your delivery leaves our warehouse, you will receive an e-mail message with a tracking number so that you can follow your delivery. If your package is to be collected at a delivery office, you will receive a notice by e-mail, or SMS if you provided your mobile telephone number, or a postal mail notice that your order can be collected.
     
  3. Although we make every effort to deliver within the stated timeframes, deliveries may take more time due to unforeseen circumstances. In the unlikely event that a delivery is more than 30 days late in delivery and the delay is not attributable to you as a customer, and no other agreement has been made, you are entitled to cancel the purchase . We will issue a refund to you, as soon as possible, including the cost of delivery (standard delivery).
     
  4. If for any reason we cannot deliver according to the delivery method you select, or to the delivery office you indicated, we will contact you. If you and we agree upon a delivery time and a drop-off location, and you do not show up or collect your product, we will charge you for any additional costs incurred.
     
  5. If you do not receive your order by the expected delivery date - please contact us at customerservice@gepcg.se.

7.Buyer’s Remorse

  1. You may change your mind about your purchase up to 14 days after having received your ordered product (hereinafter referred as at the “remorse period”). You then have another 14 days to return the products in accordance with Section 7.3 below. See Section 7.7 below for products not covered by the buyer’s remorse provision.
     
  2. The buyer’s remorse provision according to Section 7.1 presumes that the products are returned in the same conditions as they were sent when the products were delivered to you. This means that the products must not have been damaged, soiled, washed, modified or have been worn (except for simply trying on the product).
     
  3. If you wish to change your mind about the purchase, please contact us in writing within the stated buyer’s remorse deadline. We would prefer that you contact us by using the pre-printed return form that came with your parcel or in the Klarna App. If you have lost the return form, please
    e-mail us at customerservice@gepcg.se. Alternatively, you can use the Swedish Consumer Agency’s standardised form (Buyer’s Remorse Form). Regardless of which of the aforementioned methods you use, we must receive notification within the buyer’s remorse deadline.
     
  4. We will issue a refund, preferably by means of the same payment method that you used when ordering (or if payment has not yet been made for the product in question, make sure that the return is reflected in your account balance), as soon as possible, however, within 14 days after we have received your buyer’s remorse notification on the condition that we receive the products back or receive evidence that you have sent the products back. Another payment method may be used to refund you on the condition that you approve of such a modification. We will not compensate for the costs of delivery if you choose a delivery method other than the standard delivery, which entailed extra costs to you.
     
  5. On the amount that is to be refunded, we are entitled to deduct a sum corresponding to the impairment of the product compared to the product’s original value, if and to the extent that such impairment is due to you having handled the product to an extent greater than what is necessary to establish its qualities or functions.

     
  6. When returning:
    Remember always to ask for a receipt when returning products - this way, the dispatch can always be traced, and you can demonstrate that you fulfilled your return obligations. If you have been careless in your choice of carrier or in addressing and packing the product, the transportation risks accrue to you as a customer.
     
  7. Buyer’s remorse does not apply to the following kinds of products:

    a)Products that have been manufactured according to your instructions or which in some other way have been given a clearly personalised character,
    b)Products with broken seals that cannot be returned due to health or hygiene reasons, or,
    c)Audio or video recordings (for example a CD) or computer program with a broken package seal.

 

  1. Unclaimed Parcels

     
    1. If you do not collect the products you have ordered within the time that applies at the delivery office you selected, the delivery you ordered will be sent back to us. Normally, you have 14 days. For unclaimed parcels, we reserve the right to charge you for the costs of return shipping, service charges and handling charges in an amount of £14
       
  2. Complaints
     
    1. If the products you have purchased are defective, GEP will abide by the applicable consumer statutes. If you are not satisfied with your products due to an obvious material or manufacturing fault, including damages having occurred during transportation - please inform us as soon as possible by using the pre-printed return form, or e-mail us at: customerservice@gepcg.se and indicate the e-mail address you stated upon ordering, the order number and the name of the product about which you wish to complain.
       
    2. We are under a legal duty to supply products that are in conformity with your contract. Below is a summary of your key legal rights in relation to the products supplied to you. Nothing in these terms and conditions will affect your legal rights. During the lifespan of your product you are entitled to the following:

      a)Up to 30 days: if your goods are faulty, then you can get an immediate refund.
      b)Up to 6 months: if your goods cannot be repaired or replaced in accordance with Section 9.3, then you are entitled to a full refund, in most cases.
      c)Up to 6 years: if your goods do not last a reasonable length of time you may be entitled to some money back.
       
    3. If you have requested GEP to repair or replace the product, in order for GEP to be able to make a correct assessment, GEP must keep the product, packaging and transport packaging until the complaint process is complete. We will inspect the product and thereafter determine whether the complaint is valid in accordance with the applicable consumer statutes. If the complaint is valid, we will replace the defective product with a new product, correct the defect or refund the purchase price.  We always strive to send off new or repaired products within 30 days of receiving the complaint depending the type of product being returned.   
       
    4. GEP reserves the right to refuse complaints when such does not conflict with the applicable consumer statutes.
       
    5. GEP will defray the shipping costs when complaints are approved.  
       
    6. When you collect your package, it is important that you make sure that your package is not damaged. In the event of damage occurring during transport, we would appreciate you reporting directly your delivery outlet and then contacting us (see Section 17 for contact details).
       
    7. If transport damage is discovered when you get home, we at GEP ask you kindly to photograph the package/damage and contact us as soon as possible.
       
  3. Liability

     
    1. Nothing set out within these conditions preclude or limit GEP’s liability if it would be inconsistent with binding legislation to limit or preclude such liability.
       
    2. GEP shall not be held liable for indirectly losses occurring pursuant to the principle loss or damage, for example, loss of earnings or lost business opportunities, or for a failure to deliver the products in a defect-free condition and within the agreed timeframe, or the fulfilment of our other obligations under these conditions , where such failures to perform are due to circumstances beyond our control, including but not limited to measures enacted by or failures on the part of official authorities, new or modified legislation, labour conflict, blockade, fire, flood, sabotage, war, technical problems, faults in electrical/telecommunications/data connections or other connection, as well as faults or delays on the part of subcontractors due to circumstances found to be due to (force majeure).
       
    3. GEP is discharged from sanctions for faults or delays when the fault or delay is due to circumstances attributable to you or to a third party.
       
    4. GEP is discharged from sanctions for faults or liabilities when the fault or liability  is due to you having made use of or having exported the product outside of the EU/EEA.
       
    5. GEP’s liability toward you for any losses or damages that occur in connection with your order on the site is limited to the total amount of your order.
       
  4. Intellectual Property Rights

     
    1. All intellectual property rights, such as trademarks and copyrights on the site belong to GEP or its licensers. All use of our site or its content, including copying or storage of such content in whole or in part for purposes other than one’s own person non-commercial use is forbidden without the consent of GEP.
  5. Other

     
    1. GEP will report all cases of fraud and a computer intrusion, or attempts thereof, to the police. We reserve the right to deny or cancel your purchase in cases where we suspect fraud, computer intrusion and/or other form of abuse of the site.
       
    2. GEP can link from the site to other websites beyond GEP’s scope of control. GEP will attempt to ensure that GEP only links to websites that have personal data and security directives offering the same level of protection as GEP. However, GEP shall not be responsible for protection or confidentiality concerning information or personal data provided by other websites.
       
  6. Validity of the Clauses
     
    1. If one or more of the provisions set out in these conditions are invalid or are declared by judicial ruling or by an official agency to be without effect, this shall not affect the validation of the remaining provisions set out in these conditions.
       
  7. Applicable Law and Disputes

     
    1. We will do our best to resolve any disputes arising from these conditions. In the case of disputes that you and GEP cannot resolve, we recommend that you turn to the National Board for Consumer Disputes www.arn.se or write to Box 174, 101 23 Stockholm. We always follow their recommendations.
       
    2. You can also use the on-line platform for complaints available on the EU commission’s websitehttp://ec.europa.eu/consumers/odr.
       
    3. For more information about your rights as a consumer, we recommend that you visit the National Board for Consumer Disputes home page www.konsumentverket.se.
       
    4. Disputes concerning the interpretation or application of these conditions shall be interpreted in accordance with Swedish law and shall be decided according to Section 14.1 or 14.2, or as a last resort the public courts.
